Student RELEASE OF LIABILITY
ShambhavAnanda Yoga Eldorado/Shoshoni
I understand that yoga includes physical movements as well as an opportunity for relaxation, stress reduction and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. Yoga is an individual experience. I understand that I will progress at my own pace. If I experience any pain or discomfort, I will listen to my body, adjust the posture and ask for support from the teacher. I will continue to breathe smoothly. If at any point I feel overexertion or fatigue, I will respect my body’s limitations and I will rest before continuing yoga practice. Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in yoga. I represent and warrant that I am physically fit and I have no medical condition or injury that would prevent my participation in yoga. I affirm that I alone am responsible to decide whether to practice yoga. I understand and acknowledge that I am fully responsible for any and all risks, injuries, or damages, known or unknown, which I might incur or aggravate as a result of my participation.
ASSUMPTION OF RISK: I agree that I am voluntarily participating in the activities offered by ShambhavAnanda Yoga Eldorado/Shoshoni including Yoga, which includes use of the equipment, facilities and the premises. I am assuming all risk of personal injury, death, or disability to myself that may result from participation, or any damage, loss or theft of any personal property which I may incur. I understand that the ShambhavAnanda Yoga Eldorado/Shoshoni facility provides various Yoga props including blocks, mats, bolsters and other items and these may pose physical risk if not used properly.
RELEASE OF LIABILITY: I understand that I will be engaging in recreational and sporting activities while using the ShambhavAnanda Yoga Eldorado/Shoshoni Facility and it is my voluntary and informed decision to release any future lawsuits or claims that I may have against ShambhavAnanda Yoga Eldorado/Shoshoni. Therefore, I agree on behalf of myself, my personal representatives, successors, heirs, and assigns to release and to hold harmless hold ShambhavAnanda Yoga Eldorado/Shoshoni and its affiliates, instructors, officers, directors, agents, and employees (collectively "Releasees"), from any and all claims or causes of action arising out of my participation at the ShambhavAnanda Yoga Eldorado/Shoshoni facility.
This RELEASE OF LIABILITY includes all liability, claims, demands or causes of action whatsoever arising out of any damage, loss, personal injury, or death to me while participating in any of the activities offered at the ShambhavAnanda Yoga Eldorado/Shoshoni facility. This includes, without limitation, participation in Yoga classes and the use of Yoga props including blocks, bolsters, mats, chairs and other props, and the use of the ShambhavAnanda Yoga Eldorado/Shoshoni facility. This release is valid and effective whether the damage, loss, or death is a result of any act or omission on the part of any Releases or from any other cause. This Waiver and Release of Liability includes, without limitation, injuries, or accidents, which may occur as a result of the: (a) use or misuse of the facility in any way by anyone, (b) use of any equipment that malfunctions or breaks, (c) improper maintenance of the facility, grounds, or any equipment, (d) instruction or supervision, or (e) slipping, tripping and /or falling while in the facility or on the surrounding premises. This Release of Liability also expressly includes a release for any and all claims arising out of or under the Colorado Premises Liability Act (C.R.S §13‐21‐115).
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY AND A WAIVER OF ANY RIGHT THAT I MAY HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST SHAMBHAVANANDA YOGA ELDORADO/SHOSHONI SHOULD ANY CLAIM BE MADE, I UNDERSTAND AND AGREE THAT I WILL BE RESPONSIBLE FOR ALL ATTORNEY’S FEES AND DEFENSE COSTS INCURRED BY SHAMBHAVANANDA YOGA ELDORADO/SHOSHONI IN CONNECTION WITH OR IN THE DEFENSE OF THAT CLAIM.
