Yogabee Terms and Conditions
TERMS AND CONDITIONS
By attending Yogabee classes I understand and agree as follows:
I am, or will be, participating in Classes or workshops (Classes) provided by Yogabee.
My participation in the Classes and my decision to perform any exercise or pose during a Class is voluntary and I understand that any type of yoga requires physical exertion that may be strenuous and involves certain risks (both known and unknown) which may result in personal injury or other damage to myself. I am fully aware of these risks and I expressly assume the risk of any injury or other damage to myself that may arise as a result of my participation in the Classes.
I acknowledge that any injury or other damage to myself that occurs during or in relation to my participation in the Classes is not the responsibility of Yogabee and that Yogabee takes no responsibility and assumes no liability for any of my acts or omissions, or the acts or omissions of any third parties.
I release, waive, discharge and hold harmless Yogabee, its directors, officers, agents and employees from any and all liability, claims, demands, losses, damages or expenses (including legal and medical costs) that my be incurred by me during, in relation to, or which arise out of, my participation in the Classes (whether or not such Classes are held at the premises of Yogabee).
It is my sole and continuing responsibility to disclose to Yogabee and its employees all health conditions, injuries or surgeries prior to my first Class and at such other times as may be relevant. I understand that Yogabee is not medically trained and cannot assess whether I can participate in the Classes without risking my health, safety or comfort.
It is my sole responsibility to consult with a physician prior to and regarding my participation in any of the Classes. I represent and warrant to Yogabee that I am physically fit and have no physical, psychological, medical or emotional condition that would affect, or increase the risks associated with, my participation in the Classes, or would prevent my safe participation in any Class.
Yogabee has the right (in its sole and absolute discretion) to request a medical certificate from me at any time. Any information about me obtained by Yogabee or its contractors from any such medical certificate will, at all times, be kept confidential by Yogabee and its staff. I understand that Yogabee and its staff may refuse to allow me to participate in any Class as a result of any information about me revealed by a medical certificate and that I will have no cause of action against Yogabee or its directors, officers, agents or employees in these circumstances.
If I am, or become, pregnant I will inform Yogabee and its employees of this before I participate in any Class. I understand that Yogabee may exercise its right (in its sole and absolute discretion) in these circumstances to request a medical certificate from me prior to my participation in any Class.
I understand that yoga may help my general well-being but that it is not considered therapy or a replacement for medical advice from my physician.
I understand that during Classes instructors will, or may, make adjustments to my poses and that any such adjustments may require the instructor to put their hands on me. I understand that hands on adjustments are a policy of Yogabee and that it is my sole responsibility to inform the instructor prior to, or at the beginning of, a Class if I do not want them to make any hands on adjustments to my poses. I also understand that it is my sole responsibility to inform the instructor when an adjustment has gone as far as I desire.
I confirm that I am, or will be, dressed appropriately to participate in the Classes and that any clothing or garments worn by me for the purposes of my participation in the Classes are fit for such use.
I agree to follow all instructions from Yogabee and its employees at all times during the time that I am on the premises of Yogabee or participating in a Class.
Yogabee has the right (in its sole and absolute discretion) to require me to leave a Class, prevent my participation in any future Classes or cancel my membership for any behaviour it or its employees deem inappropriate, or where I have failed to comply with my obligations to Yogabee pursuant to this Release and Waiver of Liability.
I confirm that I am over the age of 18 and that I have read the above Release and Waiver of Liability carefully, that I fully understand its contents and agree to be bound by its terms.
