Algemene voorwaarden van De Yoga Tempel

1. Definitions
1. Additional Terms and Conditions: the additional general terms and conditions applicable to the Workshops, Retreats and classes organized by de Yoga Tempel.
2. Application form: The application form of de Yoga Tempel that has to be filled out and signed by the aspiring participant prior to following the classes at de Yoga Tempel
3. General Terms and Conditions: The general terms and conditions used by de Yoga Tempel, which have been published at de Yoga Tempel website, www.deyogatempel.nl. These General Terms and Conditions are also available for download at www.delightyoga.nl/en/general-terms-and-conditions.
4. De Yoga Tempel: De Yoga Tempel has its official seat at Schoolpad 16, 1521De Wormerveer Amsterdam and is listed in the Trade Register under number 50971107.
5. Single Card: a 10-class card referred to in Clause 3.3.
6. Introduction to Yoga Program: a 2-hour introduction session and one month of unlimited yoga classes, as referred to in Clause 3.6.
7. Financial Agreement: the agreement between De Yoga Tempel and the aspiring Participant of the yoga classes part of the Application Form, in which the forms of payment for this classes are set forth.
8. Membership: the membership for attending yoga classes at De Yoga Tempel, issued or to be issued by De Yoga Tempel and paid or to be paid by the Student.
9. Single Class: a single yoga class at De Yoga Tempel to be attended and paid by the Student, other than on the basis of any Membership.
10. Participant: the person who attends or wishes to attend a Retreat, or Workshop.
11. Price: the total price of a Workshop or Retreat, including the Deposit/application fee.
12. Private Class: a private yoga class at De Yoga Tempel, for which the Student must make an appointment in advance.
13. Retreat: a yoga retreat organized by De Yoga Tempel.
14. Retreat Participant: a person who takes part in or wishes to take part in a yoga retreat organized by De Yoga Tempel.
15. Teacher: the yoga teacher who has been contracted by De Yoga Tempel to teach yoga classes by De Yoga Tempel.
16. Student: a person who attends and/or wishes to attend private or group yoga classes, trainings or workshops at De Yoga Tempel.
17. Website: the website of De Yoga Tempel: www.deyogatempel.nl
18. Workshop: A yoga workshop given or to be given by De Yoga Tempel.

2. Scope of Application
1. The General Terms and Conditions apply to any membership and, where applicable, to the De Yoga TempelClass Cards, the Private Card and Single and Private Classes of and at De Yoga Tempel as well as to all Retreats, (Pre-) Teacher Trainings and Workshops.
2. By participating in a yoga class of De Yoga Tempel, the Student agrees to the applicability of these General Terms and Conditions.
3. De Yoga Tempel may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available at the Website. De Yoga Tempel will announce any amendments to the General Terms and Conditions in advance by email.

3. Flexible Membership, 1-Year Membership, De Yoga Tempel Cards, and Private Card 60 and 90
De Yoga Tempel offers the following possibilities of attending yoga classes at De Yoga Tempel:

1. FLEXIBLE MEMBERSHIP . 1-YEAR MEMBERSHIP
1. The Flexible and 1-year Membership entitles the member to an unlimited number of yoga classes during the term of the Membership.
2. The minimum Membership term for the Flexible Membership is three (3) consecutive calendar months. After the first three months, a Student’s Membership is tacitly converted into a continuing agreement for an indefinite period. The minimum Membership term for the 1-year Membership is twelve (12) consecutive calendar months. After the twelve months, a Student’s Membership will be tacitly converted into a Flexible Membership for an indefinite period.
3. The effective date of the term of any Membership is always the 1st day of the month (e.g. 1 April or 1 May). The expiry date of any Membership is always the last day of the month (e.g. 30 April or 31 March).
4. After the minimum term of three (3) months, a student’s Flexible Membership may be terminated every month. Cancellation of monthly Membership must be communicated to De Yoga Tempel in writing on the fifteenth (15th) day of the last month at the latest. As we would love to help you explore all options we are curious to the reason for you cancelation, you can send an e-mail to info@deyogatempel.nl The 1-year Membership can be terminated after the 12-month period. Cancellation of the 1-year Membership must be communicated in writing on the fifteenth (15th) day of the last month of the 12-month period at the latest. When the 1-year Membership is not cancelled it will automatically be converted into a Flexible membership (for which the normal T&C apply; only the minimum 3 month period is not required).
5. After a minimum term of three (3) months, a students Flexible Membership may be put on hold for one (1) month. This may be done by sending an e-mail to: info@deyogatempel.nl before the 15th of the month prior to the to be suspended month. The 1-year Membership may also be put on hold for 3 times for a total period of 2 months during the 12-month period. This 2 months of suspension does not count for the 12-month period; if the membership is put on hold for one month the end date of the contract will be extended with 1 month.
6. A Student may use any Membership only in the event of payment by direct debit (monthly Membership only).
7. The Membership will be debited from the students bank account around the 7th day of the month. In case De Yoga Tempel is unable to collect the Membership Fee on the first collection moment, there will be a second collection moment around the 25th day of the month. In case De Yoga Tempel remains unable to collect the Membership fee with the second collection moment, an administration fee of €25 will be charged without prior notice.
8. All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only). Find below a list of the European SEPA countries: Åland Islands (FI), Austria (AT), Belgium (BE), Bulgaria (BG), Canary Islands (ES), Croatia (HR), Cyprus (CY), Czech Republic (CZ), Denmark (DK), Estonia (EE), Finland (FI), France (FR), French Guiana (GF), Germany (DE), Gibraltar (GI), Greece (GR), Guadeloupe (GP), Hungary (HU), Iceland (IS), Ireland (IE), Italy (IT), Latvia (LV), Liechtenstein (LI), Lithuania (LT), Luxembourg (LU), Malta (MT), Martinique (MT), Mayotte (YT), Monaco (MC), Netherlands (NL), Norway (NO), Poland (PL), Portugal (PT), Réunion (RE), Romania (RO), Saint Barthélemy (BL), Saint Martin (French part) (MF), Saint Pierre and Miquelon (PM), San Marino (SM), Slovakia (SK), Slovenia (SI), Spain (ES), Sweden (SE), Switzerland (CH), United Kingdom (GB).
9. A student’s Membership commences when De Yoga Tempel has received the membership fee from the Student.

2. DE YOGA TEMPEL GUEST CARD / DE YOGA TEMPEL GUEST INTRODUCTORY CARD

1. The De Yoga Tempel Guest Card entitles the holder to two (2) yoga classses.
2. The De Yoga Tempe lGuest Card is valid for one (1) month from the date of purchase. The 1 class must therefore be attended within one (1) month of the date of purchase. After that period this right lapses.
3. The De Yoga Tempel Guest Introductory Card entitles the holder to two (2) yoga classes and can be purchased only by new students. A new student may use the De Yoga Tempel Guest Introductory Card only if he or she has not attended one (1) or more yoga classes at De Yoga Tempel.
4. The De Yoga Tempel Guest Introductory Card is valid for seven (7) days from the date of purchase. The two (2) classes must therefore be attended within seven (7) days of the date of purchase. After that period this right lapses.

3. Single CARD 10-CLASSES

1. The De Yoga TempelCard entitles the holder to ten (10) or tweny (20) yoga classes.
2. The De Yoga TempelCard - 10 classes is valid for four (4) months after the date of purchase. The 10 classes must therefore be attended within four months of the date of purchase. After that period, this right lapses. After that period, this right lapses.


5. PRIVATE CARD 60 and 90

1. The “Private Card 60” and the “Private Card 90” entitle the holder to five or ten private yoga classes of 60 and 90 minutes, respectively.
2. The “Private Card 60” and the “Private Card 90” are valid for six months from the date of purchase. This means that the five or ten classes must be attended within six months of the date of purchase.
3. During the term of the “Private Card 60” or the “Private Card 90”, the relevant Student is entitled to a 10% discount on all De Yoga Tempel Workshops.

6. INTRODUCTION TO YOGA PROGRAM

1. The “Introduction to Yoga Program” entitle the holder to one 2-hour introduction Workshop and five yoga classes.
2. The “Introduction to Yoga Program Workshop" is valid for six months from the date of purchase. The introduction workshop must therefore be attended within six months of the date of purchase. After that period this right lapses. The "Introduction to Yoga Program five yoga classes" are valid for one month after the date of the attended "Introduction to Yoga Program Workshop". After that period this right lapses.

4. Payment and Price Changes
1. All yoga classes organized by De Yoga Tempel must be paid for before they are held. De Yoga Tempel does not accept cash payments. Payments can be made by direct debit (memberships only), PIN, Credit Card (Visa, Master Card), Ideal and PayPal.
2. As a general rule, direct debits are made around the 7th day of the month. If the amount cannot be collected, a handling fee of €25 is charged. In the case of non-payment, De Yoga Tempel reserves the right to suspend the account of the relevant Student.
3. De Yoga Tempel reserves the right to change the prices. Any changes are announced in advance by putting up posters on the premises of De Yoga Tempel, by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the Website and are available for inspection at the reception desk of De Yoga Tempel.
4. On presentation of an official student card or a student public transport pass, De Yoga Tempel grants a 10% discount on all private and group yoga classes at De Yoga Tempel, except for the Introduction Card and the Membership.
5. Before a yoga class the Student must report to the reception desk of De Yoga Tempel. After the De Yoga Tempel employee has verified the registration and payment for the relevant yoga class, the Student receives a token. This token must be given to the relevant yoga teacher before the start of the yoga class.

6. Schedule
1. The current schedule is mentioned on the Website. De Yoga Tempel reserves the right to change the schedule at any time. If possible, any changes are announced in advance by putting up posters in the De Yoga Tempel rooms, mentioning them on the Website or by email.
2. De Yoga Tempel reserves the right to cancel a yoga class that has been scheduled or to change the yoga teacher mentioned in the schedule in the event of force majeure, including illness of the teacher. In this case there will be no refund of any Membership fee.
3. De Yoga Tempel is nearly always open but reserves the right to close its doors on public holidays or on other days.


7. Early Termination of Membership in case of illness
1. In the event of prolonged illness or an injury, the Student may terminate the Membership early. A request for early termination must be submitted to De Yoga Tempel in writing and must be accompanied by a medical certificate. This termination may be sent by email to info@deyogatempel.nl


8. Liability
1. Attending yoga classes, Workshops, Retreats and leaving belongings in the changing rooms are at the Student’s own risk. De Yoga Tempel accepts no liability whatsoever for physical injury, loss or damage relating to a Student’s attending yoga classes, Workshops or Retreats and leaving belongings in the changing rooms at De Yoga Tempel.
2. De Yoga Tempel works exclusively with certified yoga teachers and always ensures high-quality yoga classes. Even so, a Student always runs the risk of receiving an injury during a yoga class. By participating in a yoga class at De Yoga Tempel, the Student accepts this risk of an injury. De Yoga Tempel provides the following guidelines for reducing the risk of an injury:
1. Always consult a doctor before starting yoga classes if you are not sure that you are completely healthy or if you are pregnant.
2. If you have an injury or any other physical inconvenience, always inform your yoga teacher about this before starting the yoga class.
3. Listen to and follow the instructions of the relevant yoga teacher.
4. Perform the yoga exercises carefully and bear your physical limitations in mind.
5. Do not perform any yoga exercises that are painful.
6. Ask questions if you do not understand an exercise.
7. Avoid inverted poses during menstruation.
3. Although we strive to only provide correct information on our website, we are not liable for any inaccuracy and no rights can be derived therefrom.


9. Personal Data
1. De Yoga Tempel collects personal data of the Students and Participants to update its membership records, to execute payment orders and for administration and information purposes. De Yoga Tempel handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.
2. De Yoga Tempel uses the personal data referred to in Clause 9.1 to inform the Students and Participants about activities of De Yoga Tempel and any changes in the schedule, for example. If the Student or Participant does not want to receive communications from De Yoga Tempel, he or she may communicate this to De Yoga Tempel by sending an e-mail to info@deyogatempel.nl The Student or Participant is aware (s)he cannot use all online services and products of De Yoga Tempel in that case.
3. De Yoga Tempel never gives any personal data of the Students or Participants to third parties without their prior written consent.


10. Governing Law and Dispute Settlement
1. The General Terms and Conditions are exclusively governed by Dutch law.
2. Any disputes relating to the General Terms and Conditions, any Membership, a De Yoga TempelIntroduction Card, a De Yoga TempelCard, a Private Card or a Student’s attending group and private yoga classes, Workshops or Retreats organized by De Yoga Tempel are settled exclusively by the competent court in Amsterdam or any higher court.

11. Code of Conduct
1. Students shall adhere to De Yoga Tempel’s code of conduct at all times:
1. Please make sure you are clean and fresh when you attend the yoga class. The use of unscented deodorant is highly appreciated. In view of potential allergies of other Students, everyone is asked not to wear any perfume, aromatherapy oils or other scented products, and not to use any spray deodorant in the changing rooms.
2. Wear clean yoga clothes in yoga classes, in which you can move easily.
3. De Yoga Tempel advises not to eat later than two hours before the start of the yoga class and, in any case, not to do yoga on a full stomach.
4. Please do not wear shoes in the yoga studios.
5. De Yoga Tempel makes yoga mats available for use during yoga classes. After classes, a yoga mat must always be cleaned and put away by the Student who has used it.
6. To allow everybody to find perfect inner peace, Students are requested not to talk in the yoga studio before, during and after the yoga class and to talk quietly in the other rooms.
7. The physical and mental integrity of Students must always be respected. Sexual behaviour or sexually suggestive behaviour is not tolerated by De Yoga Tempel.
2. De Yoga Tempel reserves the right to deny Students who do not observe the house rules referred to in Clause 11.1 access to the De Yoga Tempel premises and to terminate the Membership of the relevant Student without a refund of any membership fee paid already.

ADDITIONAL GENERAL TERMS AND CONDITIONS FOR WORKSHOPS, AND RETREATS OF DE YOGA TEMPEL


12. Applicability of Additional Terms and Conditions and Definitions
1. Retreats, and Workshops are governed by these Additional Terms and Conditions in addition to the General Terms and Conditions. The General Terms and Conditions form an integral part of these Additional General Terms and Conditions. By participating in a Workshop, (Pre-) Teacher Training or Retreat, the relevant Participant accepts the applicability of the General Terms and Conditions and the Additional General Terms and Conditions.

13. Participation in Workshops and/or Retreats and Registration Fee
1. A Participant may participate in a Workshop or Retreat after he or she has registered for it with De Yoga Tempel in advance and paid the Price. Registration may be effected by sending an email to info@deyogatempel.nl A spot in the Workshop or Retreat is guaranteed after De Yoga Tempel has received payment of the Price or the Deposit/application fee.
2. For some Workshops and Retreats, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date the normal rate, which is also specified on the Website, applies without exception.

15. Payments and Prices
1. The Price for a Workshop or Retreat can be found on the De Yoga Tempel website.
2. Payments for a Workshop or Retreat must be made before the Workshop or Retreat is held. Payments can be made by direct debit, IDEAL, PIN, PayPal
3. In the event of participation in a Retreat, the Deposit/application fee must be paid 60 days before the scheduled Retreat at the latest. The balance must be paid 30 days before the Retreat scheduled at the latest.

16. Cancellation of Workshop Registration
1. Any participation in a scheduled Workshop may be cancelled only in writing. Cancellations can be done by sending an e-mail to: info@deyogatempel.nl.
2. Until one (1) month before the scheduled Workshop date, the Participant may cancel his or her registration free of charge.
3. Until two (2) weeks before the scheduled Workshop date, the Participant may cancel his or her registration, in which case the registration fee is refunded, less a handling fee of €25.
4. If the Participant cancels his or her registration later than two (2) weeks before the scheduled Workshop, the registration fee is not refunded.

17. Cancellation of Participation in Retreat
1. Any participation in a scheduled Retreat may be cancelled only in writing. This can be done by sending an email to info@deyogatempel.nl.
2. The Retreat Participant may cancel his or her registration free of charge until two (2) months before the scheduled Retreat.
3. In between two (2) months and one (1) month before the scheduled Retreat, the Retreat Participant may cancel his or her registration, in which case 50% of the Price is charged.
4. If the Retreat Participant cancels his or her registration within one (1) month before the start of the Retreat, the Price already paid is not refunded.
5. If it turns out at the location of the Retreat that the Retreat Participant cannot participate in the Retreat for whatever reason, the Price already paid is not refunded.
6. De Yoga Tempel reserves the right to cancel the Retreat if there are insufficient participants. In this case, the registration fee already paid by the Participants is refunded immediately.


20. Workshop
1. The current Workshop Training Schedule can always be found on the Website. De Yoga Tempel reserves the right to change the schedule at any time. If possible, any changes are announced in advance by putting up posters in the De Yoga Tempel rooms, mentioning them on the Website or by email.
2. De Yoga Tempel reserves the right to cancel a scheduled Workshop in the event of force majeure (including illness of the relevant teacher). In this case, the registration fee already paid is refunded.

21. Health
1. The Pre Teacher Training, the Teacher Training or the APT have an intensive schedule and curriculum that is physically, mentally, and emotionally demanding. By participating, the Participant declares that he/she is healthy on a medical and mental-health level and is ready to fully participate in the demands of the program of the Pre Teacher Training, the Teacher Training or the APT, as the case may be. Additionally, the Participant must be able to support the group learning process. The Participant may be requested to leave the Pre Teacher Training, the Teacher Training or the APT, as the case may be, if it is determined by the Teachers that his/her participation would in any way compromise a safe and cohesive learning environment.
2. By participating in the Pre Teacher Training, the Teacher Training or APT, as the case may be, the Participant declares that he/she is aware that it is his/her own responsibility to take care of his/her own health and well-being during such training at all times.
3. In addition to the stipulations of article 20.1, De Yoga Tempel reserves the right to require clinical evaluations or other information to competently evaluate the Participant's medical and/or mental-health preparedness.

22. Code of Conduct
1. Participants shall adhere to De Yoga Tempel’s code of conduct at all times:
1. Please make sure you are clean and fresh when you attend the yoga class. The use of unscented deodorant is highly appreciated. 7. The physical and mental integrity of Participants must always be respected. Sexual behaviour or sexually suggestive behaviour is not tolerated by De Yoga Tempel.
2. De Yoga Tempel reserves the right, at its discretion, to deny Participants entrance to De Yoga Tempel and terminate their participation in classes or retreats, as the case may be, who do not adhere to the code of conduct as set forth in article 21.1, or do otherwise disturb the peace, without reimbursing any already paid Price.

23. Liability
1. De Yoga Tempel shall not be liable for any injury, loss or damages in connection with, or resulting from, participation in the Pre Teacher Training or the Teacher Training, as the case may be.
2. The Participant will never engage De Yoga Tempel, the Teachers, or any of the supporting staff, in legal proceedings relating to possible damages in whatever form, that may be the result of participation in classes or retreats, as the case may be.
3. De Yoga Tempel only works with qualified yoga teachers and will always offer yoga classes of the highest quality. Nonetheless, there is always a risk of injury involved when taking a yoga class. By participating the Participant accepts such risk of injury. De Yoga Tempel offers the following guidelines to diminish the risk of injury:
- Consult with a physician when you are not sure you are completely healthy, or if you are pregnant, before starting to take yoga classes.
- If you have an injury, or other physical issue, inform the yoga teacher thereof before you start your yoga class.
- Listen to and follow the instructions of the yoga teacher.
- Be conservative when exercising yoga and listen to your physical limitations.
- Don’t do any exercises that are painful.
- Ask questions when you do not understand an exercise.

24. Applicable law, dispute resolution
1. Dutch law applies exclusively to the General Terms and Conditions.
2. Any disputes in connection with the General Terms and Conditions, or the participation in a Workshop or, Retreat, as he case may be, will be resolved exclusively by a certified mediator.
