Tücsi Yoga's Terms & Conditions
Article 1. The Agreement
1.1 These Terms & Conditions as outlined below are applicable to all agreements with Tücsi Yoga concerning participation in classes, workshops, courses, trainings and other forms of education or advise. All agreements are made by registering and signing in through Momoyoga application. Deviations of this agreement are only binding in case they have been confirmed in writing by Tücsi Yoga.
1.2 Health: Every participant is required to immediately inform the Yoga teacher about physical or psychological problems. Tücsi Yoga will not be held responsible in case of injury during or after the Yoga class. Tücsi Yoga reserves the right to refuse a participant or to deny them the class or workshop. If the participant still joins, this is completely at their own risk. When you have any doubts about physical or psychological problems, please always contact your general practitioner.
1.3 Participating in one of the classes means that you agree with Tücsi Yoga's Terms & Conditions.
Article 2. Payment and Membership
2.1 Class Fees and Memberships:
All class fees and membership prices are as mentioned and listed on the website or Momoyoga app of Tücsi Yoga.
2.2 Payments:
All payments will be transferred by direct debit payment to ASN bank account number NL67 ASNB 0708 8881 78 in the name of S. Kali. Cash payments in the studio are also possible. In this case, the amount due must be paid before participating in yoga classes, workshops, sessions, courses, or retreats.
2.3 Redundant Payments:
If a payment is not received on time, Tücsi Yoga reserves the right to claim collection costs on your account and/or reserves the right to refuse a participant or to deny participation in yoga classes, workshops, sessions, courses, or retreats.
2.4 Change of Subscription Fees:
Tücsi Yoga reserves the right to change the fees. Tücsi Yoga is committed to informing its members promptly about payment and pricing alterations. At all times, a member can terminate the agreement if he/she does not agree with the change.
2.5 Class Cancellation:
In the event of a missed yoga class due to sickness, holidays, or unforeseen circumstances, members are required to cancel or reschedule any class up to twenty-four (24) hours before its scheduled time. Classes can also be reserved up to eight (8) hours prior to their start time. This policy ensures fair access and allows for timely adjustments to the class schedule using the Momoyoga app. Please be advised that no refunds will be provided for expired classes.
2.6 Class Cancellation by Tücsi Yoga:
Tücsi Yoga reserves the right to change the Terms & Conditions, class schedule, location, and prices at any time. Tücsi Yoga also reserves the right to change or cancel yoga classes, workshops, mini-retreat / workshops, calm walk 10-week courses, shinrin-yoku (forest bathing) sessions, and "Omdat Yoga Retreat" without providing further reasoning.
2.7 Cancellation Policy for Tücsi Yoga Hosted Workshops, Mini-Retreats, and Classes:
In the event of a cancelled Tücsi Yoga hosted workshop or mini-retreat (excluding "Omdat Yoga Retreat"), a full refund of the costs will be issued.
If a yoga class is cancelled, members have the option to make up for this class at any other time during their membership period.
Please note that there is no refund option for cancelled classes.
2.8 Omdat Yoga Retreat Cancellation:
Tücsi Yoga's "Omdat Yoga Retreat" is organized in partnership with Create Space Yoga (CSY). Please note the following cancellation terms:
All "Omdat Yoga Retreat" payments made to the business account of Create Space Yoga are non-refundable, and cancellation leads to the loss of all funds paid.
In the event of cancellation due to medical reasons, death in the family, accidents, and/or natural disasters preventing the participant from traveling to an "Omdat Yoga Retreat," CSY will issue an Insurance Claim Letter to assist with potential insurance claims.
2.9 Holidays:
The studio is closed during the following holidays, and no classes are given: 2 weeks during Christmas and New Year’s, Carnival, Good Friday, Easter (Pasen & 2nd Pasendag), Kings day, Ascension Day (Hemelvaartsdag), Pentecost (Pinksterdag & 2nd Pinksterdag). During summer holidays, there is an adjusted schedule. This schedule and any other alternating deviations will be mentioned on the available Momoyoga app.
2.10 Termination of Membership:
Membership termination is possible with written notice, to be submitted in a written form one month before the desired cancellation date.
2.11 Monthly Membership Details:
The Monthly Membership includes access to all recurring yoga classes. Members benefit from a 20% discount on events and workshops organized by Tücsi Yoga. Additionally, the membership offers the flexibility to pause or transfer to another student.
2.12 UNLIMITED MEMBERSHIP 1 YEAR Details:
The 1-Year Unlimited Membership entails unrestricted access to transformative yoga and Calm Walk sessions for a duration of one year. Members will partake in a variety of yoga sessions, forest bathing, and activities promoting balance and overall well-being throughout the membership period.
2.13 Cancellation of UNLIMITED MEMBERSHIP 1 YEAR Benefits:
In the event of membership cancellation before the completion of the one-year term, members forfeit the remaining benefits for the remaining duration. Members must provide written notice of cancellation, and the termination process must be completed at least one month before the desired cancellation date. If you decide to stop or pause your membership, the changes will take effect 30 days after your request. No refund of fees will be issued upon cancellation. Despite cancellation, members have the option to transfer the remaining benefits to another eligible student.
Article 3. Own risk and liability
3.1 Incase Tücsi Yoga might be liable; this liability is limited to what has been arranged in these terms & conditions.
3.2 Tücsi Yoga is never responsible for indirect damage, materials or items.
3.3 If applicable, the responsibility of Tücsi Yoga is in any case limited to the amount of dividend of their insurance.
Article 4. Privacy
4.1 Tücsi Yoga processes the personal details of a member within the framework of the applicable laws and regulations concerning the protection of personal ambiance, in particular the Personal Data Protection Act, in a way and for the purpose we further specify below.
4.2 Tücsi Yoga processes personal data for the following purposes: invoicing, debtor administration, complaint management & dispute settlement, information to the employer of the member about the use of the membership, prevention, tracing & fight of fraud & irregularities, for field research and commercial purposes such as sales activities related to services of Tücsi Yoga and/or services of third parties in relation to the services of Tücsi Yoga.
4.3 A member has the right to insight, correction & resistance of his/her personal data used by Tücsi Yoga. Tücsi Yoga reserves to right to pass the costs for looking into and/or processing corrections or acts of resistance to the member with a maximum by law. For an objection against processing of his/her personal data and request of insight, correction and/or resistance, the member can address Tücsi Yoga.
